I got burned, Need advice
« on: 03/20/18 10:21AM »
A so called "friend"came to me recently needing a place to store a couple bikes while he sells them I reluctantly agreed and posted on CL and here but told him repeatedly it was short term. Long story short I bought one of the bikes but he has now left the country for at least a year leaving me with a Tuano a box of parts and  another motor and frame. I'm subletting the space a need it it all gone , What are my options?

I don't think there is a "nice" way of handling it.  Either option will piss one or the other party off.  Right now your friend left you responsible for "his stuff" without regard to your needs.

If I were in your shoes, I would take the Tuono as "Payment", take ownership somehow, ride it and try to sell it off.  Same with all the parts.  If that's not an option, sell it as junk and get next to nothing?  Can you store it somewhere else so you can go ahead and sub-lease the space?  Money talks and BS walks so your priority is the sub-lease of the space.  Maybe keep the bikes outside, under cover and behind a locked gate until you can sell it to someone.

You can look into putting a lien against the items and having a lien sale, if you are worried about covering yourself legally.

I had a motorcycle "on standby" while the owner "got the funds together to get it going again" ... The total bill was $500.  I had to move the motorcycle 3 times when I moved over the course of two years.  I monitored the battery, kept it on a tender, started it up once a month, and never heard from the owner. I would call every couple months and if the phone was picked up it was the same story about "getting funds together." I lien-sale'd the motorcycle and sold it.  Went through all the legal proper journals.

Got a furious phone call about how I was supposed to hold onto the bike and how I was a terrible person.  I felt troubled causing conflict to another person but remembered all the conflict and trouble caused for myself over the last two years which helped brush my shoulder off.

I saw the for sale ad and thought he has the title for it. So how is he selling it without title while he’s away?

If he has the title and he’s out of the country then how are you suppose to sell it for him? Or do snhe expect you to just store it until he returns?

Forget Cars for Kids. And good luck getting that song out of your head now. Calll Aumari. I think he's in FV. All he does is Aprillia work. He knows plenty of track day rider and may know the proper legal way to deal with a lien or abandoned bike on your premises. I can send you his ph #.

Klaus sounds like he knows the whole lien process. I know it's a PITA to have to deal with, but probably worth it at this stage if there's no hope for his return any time soon.
